Between Targetti Sankey SpA, the owner and manager of the "Portale della Luce" on the internet network, and the originators/grantors, having premised the existence and purposes of the "Portale della Luce" as described in the enclosed leaflet, hereby agree the following:
A) Granting of user rights of intellectual works
A1. The originator/grantor shall authorize the Portal to use the materials requested for educational, cultural and information activities. Where necessary, or if easier, the expressive, textual or pictorial representation of the intellectual work granted may even be taken from the personal website.
A2 The authority given shall in no way compromise the author's ownership or copyright of the work in question.
A3. The Portal shall have the right to adapt the texts and pictures to the most suitable dimensional and expressive format for representation on the Portal, as long as it declares that the work has been partially manipulated, and also states the originator/grantor and source. Any conformation shall in any case be limited, and shall be carried out in such a way as to avoid compromising the specificity of the work, also with regard to the artistic communicative content of the same, and in any case, in order to avoid damaging the image of the originator/grantor.
A4. The Portal may use the intellectual work by quoting or reproducing the same, even partially or in a manipulated format, for information or reference but not commercial purposes regarding for the Portal itself, always stating the originator/grantor, the source, and any manipulative treatment carried out.
A5. The above authority is granted free of charge and may be revoked at any time by the originator/grantor at the discretion of the same.
A6. The originator/grantor shall guarantee that no third party may claim any rights for the work from the Portal, i.e. the originator/grantor shall undertake to guarantee free derogation in favor of the Portal, even with regard to the manipulation of the work and shall, in any case, absolve the Portal from any damages which may arise as a consequence of any claim put forward by a third party.
B) Granting of virtual space
B1. Where requested, it will be available in the Portale della Luce a virtual space where the professional shall have the right to publish, under his or her own responsibility, texts, pictures and expressive reproductions of his or her intellectual works on the theme of lighting technique.
B1. Anything published in the virtual space provided may be used free of charge by the Portal users, as well as the Portal itself for educational, cultural and information activities carried out by the same through the "Portale della Luce", as well as on subsequent occasions in traditional settings, as well as for the information and reference but not the commercial promotion of the Portal itself, always quoting the name of the originator and the source.
B3. The virtual space, according to the dimensions of the contribution, shall be provided free of charge.
B4. The Portal shall not be responsible for any unlawfulness concerning the material published, and the person requesting the virtual space shall guarantee that anything published shall be his or her own exclusive property and/or legally available to the same, and that such material does not damage or compromise the rights and privileges of any third party; in particular, the said person shall undertake not to publish any texts which may potentially damage the image and name of any third party. The person requesting the space shall absolve the Portal of any possible harmful consequences, which may ensue.
The Portal shall request personal data and information to be provided by means of a special form, and shall guarantee that the personal data and information supplied shall remain confidential, unless the same is already public property, and that it shall be treated in compliance with the Italian Laws on Privacy. The person concerned may ask at any time for his or her data to be updated, supplemented, corrected or cancelled.
A) REGULATIONS FOR USING THE PORTAL
1) The access and use of this web site, as well as the products and research services available, shall be subject to the following terms and conditions. Use of the site implies the acceptance of all the terms and conditions. This web site contains links to other web sites, which in turn may be subject to special conditions of use stated within the individual sites. The Portal shall not be responsible for the incorrect use of sites reached through the aforementioned links, or any use of the same which does not comply with their special conditions of use.
2) The articles, studies, reviews and photographs published on the "Portale della Luce" shall be protected by copyright which shall safeguard the economic exploitation rights of the originators and/or the Portal. Nothing contained in this web site may be interpreted, either expressly or implicitly, as the granting of the intellectual property rights of the Portal or any third party. The Portal's logo, the registered trade-marks, and any other trade-marks present on this site, shall remain the property of the Portal itself or the third parties who hold the rights to the said trade-mark. As a consequence, the use of logos and trade-marks found on the site and other linked sites shall be prohibited.
3) The access to and the consultation of the materials published is free of charge.
a) The downloading, reproduction, modification, display, distribution, transfer, publishing, creation of spin-offs, granting of licenses, selling or the use in any way of any information, product or service contained in the site - for all commercial purposes - shall be prohibited. This limitation shall also include the prohibition to duplicate the home page or the research pages of this site or any site linked to the same in a personal web site.
b) The web sites found through external search engines, as well as the linked sites, are developed and handled by third parties over which the Portal has no control. The indexing of the external search engines is mainly carried out automatically, therefore the Portal can in no way control the operation or the results of the same. Consequently, the Portal declines any responsibility regarding the contents of sites found as a result of the research, and shall therefore not be responsible for any inaccuracies, errors or omissions found in the results of the research, nor for the possible illegal, offensive or in any way censurable content of the sites found as a result of the research.
c) The Portal is not able to provide any kind of filter regarding the advisability or legitimacy of the contents of the messages sent in the "Forum" and "Chat Line" areas. As a consequence, it shall not be responsible in any way for damage to the personal or property rights of others which may occur through the content of the messages themselves, and shall moreover not be responsible for the nature, truthfulness, origin or anything else concerning the form and content of the messages. Any such liability shall be the exclusive responsibility of the person providing the said content.
d) The Portal shall reserve the right to suspend the service or to carry out the subsequent censorship of the contents sent, in the event that it should discover, according to its own unquestionable judgment, any violations of laws, regulations or any other legal measure, or in the event of the inadvisability of the contents.
e) The Portal shall decline all responsibility for any changes made to any contents of the Portal carried out by unauthorized third parties (hackers and suchlike).
f) The Portal shall guarantee that at any time the originator/supplier may request that his or her data be updated, supplemented, corrected or cancelled.
3) FINAL DISPOSITIONS:
The Portal shall reserve the right to modify these regulations at any time, without notice.
These regulations shall be disciplined and interpreted in compliance with existing Italian law, with the express exclusion of the choice or application of any other regulatory law. The user shall expressly accept the choice of this law, and any eventual disputes deriving from the use of this site shall be disciplined by Italian law.
